More Instructors: Darren Elkind is a member of the law firm Paul & Elkind, P.A. His areas of practice are
personal injury, wrongful death, commercial litigation, municipal law, zoning and land use, and has been
practicing law in the West Volusia County are since 1995. Mr. Elkind is board certified in civil trial law
by The Florida Bar and routinely represents both individuals and corporations in courts throughout east
central Florida, with an emphasis on providing aggressive representation to each of his clients. In addition
to a busy civil litigation practice, he also represents land owners and developers throughout Volusia
County in every phase of the land development process. Mr. Elkind also serves as City Attorney for the
City of DeLand and as a special magistrate for the City of Sanford's code enforcement proceedings. He is
uniquely well suited for litigating matters involving land development issues. Mr. Elkind earned his B.S.
degree from the University of Tampa and his J.D. degree from Syracuse University College of Law. He is
a member of the Volusia County Bar Association and The Florida Bar (city, county and Local
Government Law Section). Donald Hemke is a shareholder with Carlton Fields, P.A. in Tampa, where his experience
includes zoning/land use/environmental, governmental and construction litigation. Prior to joining
Carlton Fields, P.A.; he served as a law clerk for Hon. John W. Peck of the 6th U.S. Court of Appeals.
Mr. Hemke has tried land use/zoning cases, including Section 1983 civil rights cases, for landowners in
federal court. In addition to litigation, he often is involved in obtaining government permits and licenses.
Mr. Hemke also has represented owners, suppliers, contractors and subcontractors in construction cases
involving delay, inefficiency, hindrance and differing site condition claims. He speaks and writes
frequently on zoning and construction law. Mr. Hemke is a member of the American and Hillsborough
County bar associations and The Florida Bar. He has served as an arbitrator for the U.S. District Court for
the Middle District of Florida and the American Arbitration Association. Mr. Hemke earned his J.D.
degree from the University of Virginia Law School and his B.A. degree, cum laude, from Vanderbilt
University. S. Brent Spain is a partner with Theriaque & Spain, where he practices primarily in the areas of land
use, local government and administrative law, with an emphasis on land use litigation, and appellate
advocacy. He currently represents private individuals, developers, and local governments in various land
use and zoning matters throughout Florida. Mr. Spain is a frequent lecturer on land use related topics and
has written several land use related articles. He earned his B.A. degree from the University of California-
Davis and his J.D. degree, magna cum laude, from Florida State University. Prior to entering private
practice, Mr. Spain served as a judicial law clerk for Justice Harry Lee Anstead of the Florida Supreme
