This session will provide a comprehensive overview of the law governing development exactions and conditions. The session will define and provide real world examples of various types of development exactions. Relevant US Supreme Court and Nevada case law will be reviewed and the judicial and political climate for exactions and takings will be discussed. In addition, the concepts of “nexus” and “rough proportionality” will be discussed.The session will include practical tips for dealing with exaction issues and conditions. This session is sure to be helpful to both public sector planners and those representing private developers.
