Instructors:
Sara E. Bouley
is a founding member of Action Law LLC, where she is an experienced commercial
litigator who concentrates her practice on complex business and corporate law, real estate law, foreclosures,
easements, boundary disputes, title and escrow issues, construction disputes, lender liability, mortgage fraud,
quiet title actions, commercial landlord/tenant disputes, and mechanic's liens. She also is a licensed private
pilot who enjoys practicing aviation law; including representing pilots in FAA enforcement actions. Ms.
Bouley is a Real Property Utah State Bar Examiner, treasurer of the Real Estate Section of the Utah State Bar,
a CREW Utah member, and a former chair of the Real Estate Practice Group at Fabian & Clendenin, P.C. She
is a member of the American Bar Association, Utah State Bar and Lawyer Pilots Bar Association. Ms. Bouley
is admitted to practice before the U.S. District Court, District of Utah and Tenth Circuit Court of Appeals. She
earned her B.A. degree from the University of Texas, her M.A. degree from the University of Nevada and her
J.D. degree from the University Of Utah College Of Law.
Gregory M. Simonsen
is a shareholder in the Salt Lake City law firm of Fetzer Simonsen & Booth,
P.C., where he practices in the areas of construction, real estate and land use law. He has written numerous
published articles on construction law, zoning and planning issues and lectured widely on these same issues.
Mr. Simonsen earned his B.S. degree, magna cum laude, and J.D. degree from the University of Utah, where
he was a member of the Utah Law Review. He is past chairman of the Construction Law Section of the Utah
State Bar, a member of the Forum on Construction Law of the American Bar Association, a past member of
the West Jordan Planning Commission and formerly Vice President of the Board of Trustees of the Utah
Transit Authority.
Bret F. Randall
is the chair of Durham Jones & Pinegar, PC's environment, energy, and resources
practice group and practices in the Salt Lake City office, where his main areas of practice are environment and
energy law, and business and finance. His practice includes managing industrial facility siting, permitting, and
compliance issues under federal, state, and local environmental laws and regulations. Mr. Randall also
regularly represents clients in matters involving Superfund liability, Clean Water Act permitting and
compliance, wetlands permitting, worker health and safety, pipeline health and safety laws and regulations,
and environmental management programs. He has particular expertise in site investigation, remediation, and
redevelopment, having assisted in the acquisition, management, and redevelopment of numerous
environmentally sensitive properties, including many NPL-listed Superfund sites. Mr. Randall earned his B.A.
degree from Brigham Young University and his J.D. degree, summa cum laude, from Brigham Young
University, J. Reuben Clark Law School.
J. Craig Smith
is a founding member of the Salt Lake City firm of Smith Hartvigsen, PLLC, where he
practices in the areas of water law, land use, and redevelopment law. He has argued more than 30 appeals
before the Utah Supreme Court. Mr. Smith is listed in Utah Legal Elite, Superlawyers and Best Lawyers
publications. He was a law clerk for the Hon. J. Robert Bullock for the Fourth District of Utah and an assistant
city attorney for Park City, Utah. Mr. Smith has written “Local Government Regulation and Bankruptcy: To
Stay or Not to Stay,” Urban Lawyer 151-176, Volume 21, Number 1, Winter, 1989; “Bankruptcy and
Development Regulations,” Urban Land, April 1981; “Ethics and the Government Lawyers,” Utah Bar
Journal, Volume 6, Number 2, February 1993; “Basic Utah Water Law,” Utah Bar Journal, Volume 7,
Number 2, February 1994; and “A Preference for Domestic Use in Utah: A Relic of The Past?” ABA Water

from the College of Eastern Utah; and his B.A. degree, magna cum laude, and J.D. degree, cum laude, from
Brigham Young University. Mr. Smith is a member of the American Bar Association and the Utah State Bar
(Sections on Urban, State and Local Government Law, Natural Resources and Litigation). In 2004 the Utah
State Bar (Energy, Natural Resources and Environmental Law Section) recognized him as Lawyer of the Year.
