Zoning Code Rewrite

The County of Maui is inviting qualified planning and zoning consultants to submit a written proposal in response to this Request for Proposals (RFP) to provide professional services for the purpose of rewriting Title 19 Zoning, Maui County Code.

Maui County is comprised of three inhabited islands — Maui, Molokai and Lanai and its land use regulatory framework has evolved over many years. The County's current Zoning Code dates from 1959 and as is the case with any dynamic process, it has undergone scores of changes to accommodate new conditions and broader responsibilities. Many of the problems encountered in administering the code can be attributed to the piecemeal fashion in which it has been amended over the years. The result is a cumbersome and somewhat confusing organization of the code; provisions and terms that are often ambiguous, inconsistent, outdated or obsolete, and redundant; complex permit review and code enforcement procedures; and standards that do not promote the livable built environment that is identified in the General Plan.

An audit of Title 19 Zoning, MCC was conducted by Orion Planning and Design and completed in March 2018. The full report may be viewed at https://www.mauicounty.gov/DocumentCenter/View/112081. The selected consultant will be very familiar with the results and recommendations included within the audit and will use the results as a foundation for the zoning code rewrite. Consultants will also be expected to have a thorough understanding of the County's General Plan documents (the Countywide Policy Plan, Maui Island Plan and Community Plans), and other related plans, Administrative Rules and ordinances (e.g. Hawaii Revised Statutes, Shoreline Management Area, etc.), and their relationship to and effect on the zoning code.

The County of Maui has recently adopted a digital GIS zoning map layer for the Island of Maui to replace old paper maps. While preliminary draft, unpublished digital GIS zoning map layers exist for Molokai and Lanai, their adoption is not anticipated until approximately 2019-2021. All digital GIS layers will be available to the selected Consultant for use in this project.

The County of Maui is currently updating the community plan land use designations, as recommended in the Title 19 Zoning audit, to facilitate place-based land use planning that will complement the development of a hybrid zoning code.
