Review / Rewrite of Zoning Regulations

The City of Hays, Kansas, a community of 20,000 located along I-70 in west central Kansas recently completed a major comprehensive plan update that addresses key smart growth issues such as human-scale mixed-use development, housing choices, transportation options, cost-efficient urban services, and natural resource protection, among others. However, the city’s zoning code and related development regulations and development policies are basic and “first-generation”. Sections of the Code have been amended from time-to-time but have few progressive provisions related to the community’s key development issues.
The City of Hays is currently soliciting qualified professional planning consultants to submit professional qualifications to perform a review and possible re-write of the current zoning and subdivision regulations. The chosen firm will review existing regulations and propose amendments that would emphasize administrative flexibility to accommodate development opportunities and to eliminate regulations that do not promote a legitimate, identifiable public interest. The Consultant will also assist with the review and update of a draft Development Procedures Policy to ensure compatibility with the updated regulations.
The proposal should clearly demonstrate how the firm can best satisfy the requirements of the City of Hays. The City shall reserve the right to enter into an agreement with the firm presenting the proposal that is most advantageous to the City of Hays.
The primary objective in undertaking this Project is to identify and examine the challenges faced by the City and to identify appropriate strategies and opportunities that take advantage of the City’s existing and potential strengths. The update to the regulations will review existing regulations and propose amendments that would emphasize administrative flexibility to accommodate development opportunities and to eliminate regulations that do not promote a legitimate, identifiable public interest. The City’s updated Zoning Regulations must be compatible with the recently adopted Comprehensive Plan and must help define a vision of Hays’ future that will inspire, guide, and direct growth in the City while being responsive to citizen needs and desires.
The scope of this project will review the existing zoning and subdivision regulations and develop amendments that have been adequately vetted through a public process and shall:
• Emphasize administrative flexibility to accommodate development opportunities and to eliminate regulations that do not promote a legitimate, identifiable public interest.
• Be Balanced, in terms of facilitating growth and development and protecting landscapes, resources, and public health, safety and welfare;
• Be Fair, in that they make it clear to landowners, the real estate and development community, development review agencies and staff, and the public what is expected in terms of subdivision development, including design, evaluation of impacts, and the review process;
• Be User-friendly for the variety of users including developers, developers representatives, governing officials, agency personnel, and residents and landowners.
To achieve these objectives, the City proposes to retain the services of a qualified and innovative consultant firm or a collaborative consultant team with a demonstrated ability to work interactively with the City Commission, Hays Area Planning Commission, planning staff, Hays citizens, the corporate community and other stakeholders to develop an updated set of Zoning and Subdivision Regulations. The selected firm(s) must have both a demonstrated command of state-of-the-art planning concepts and techniques, including smart growth along with sustainable and livable communities’ approaches to development, and demonstrated facilitator skills. The Consultant, or team, with the assistance of the planning staff and other City officials, will engage and interact with the citizens and stakeholders who must be involved to ensure that the set of Zoning and Subdivision Regulations that emerges from the process garners the essential buy-in from primary constituencies.
The Regulations shall contain guidelines that are achievable and based on sound analysis and realistic objectives. The City believes that in order for the future vision and the resultant goals, policies, objectives, and actions strategies of the Zoning Regulations to be effective, they must be developed using an inclusive, participatory process that includes an extensive and effective public outreach component. List in detail how you propose to provide the services along with a schedule of fees to provide such services.
