Overview

This Session will discuss the complexities of regulating Sexually Oriented Businesses (SOBs) as "free speech" under the First Amendment. The focus will be on how local communities can meet the legal tests outlined in US Supreme Court, the Ninth Circuit Court and other case law to provide for freedom of expression while addressing community concerns related to these businesses. The case study of regulating SOB’s in the Fairbanks area will be used as an example.
