Overview

This session will address current topics in planning law and policy. Topics will include:  land development conditions, housing exactions (inclusionary zoning), public trust doctrine, native Hawaiian traditional and customary rights, regulatory taking of land and the so-called “relevant partial” issue following the US Supreme Court 2017 decision in Murr v. Wisconsin,  court appeals from administrative agency decisions, housing discrimination under the US Fair Housing Act,  due process in hearings, and implied preemption of local government regulation by the state.
