Overview

During this session land use attornies will discuss Section 15.2-2303.4 of the Code of Virginia, Provisions applicable to certain conditional rezoning proffers, and its impact on residential land use, rezoning and local governments.  Specifically, participants will examine the history of conditional zoning; the legal reach of changes in conditional zoning law both historic and current; applicability based on land use and on- or off-site improvements proffered; and, differences in the provisions of evidence required by a local government and the aggrieved or property owner relative to proffer unreasonableness.  In addition, partcipants will receive, through examination of recently adopted practices by local governments, differing stragetegies adopted by planners to comply with the new law.
