Solar Energy

The city's zoning code defines several solar energy system and solar access related terms (Sec. 220-9).

The zoning code also includes a section on solar energy systems and solar and earth-sheltered structures, establishing them as permitted uses in all districts if compliant with minimum lot requirements and setbacks and if systems are in good repair (Sec. 220-56.A). Systems may be exempted from setback, height, and lot coverage restrictions by variance (Sec. 220-56.B).

The code establishes a defined solar access right to protect solar energy systems from shading by structures or vegetation, though preexisting structures and vegetation is exempt. Violation is a private nuisance; solar energy system owners may file notarized photographs to document installation of their systems (Sec. 220-56.C,D).
