This article from the University of Maine Law School examines conventional zoning ordinance provisions that prohibit urban agriculture, including bans on front-yard vegetable gardens, prohibiting produce sales, and banning backyard chickens, and their traditional justifications. It then explores justifications for replacement of proscriptive urban agriculture bans with prescriptive and permissive urban agriculture policies and the use of urban agriculture by municipalities as a tool to promote public health, safety, and welfare goals. The article concludes by offering potential solutions and discussing broader implications.
