Marijuana-Related Uses

The city’s zoning code includes definitions and use-specific standards for multiple medical-marijuana-related uses (§27-900 et seq.). However, it also explicitly prohibits these uses until such time as federal or state law preempts local prohibitions.

The code defines three types of “medical marijuana establishments”: “marijuana farm,” “medical marijuana dispensary,” and “medical marijuana treatment center” (§27-900).

Its use-specific standards for medical marijuana establishments address zoning district use permissions; separation from other marijuana-related uses, residential districts and uses, churches, schools, daycares, and parks; screening of building openings; parking; parking lot lighting; hours of operation; security; community relations contacts; seating; drive-through, drive-in, and walk-up services; outside sales, service, and consumption; outside cultivation; grow lights; and gas products and generators (§§27-906–7).

Solar Energy

The city's zoning code allows the building department to issue permits for solar energy collectors if "effectively and permanently" screened from view; if system cannot be fully screened, plans are required showing that solar collector will be installed flush to roof, or that non-flush installations will be skirted with identical roof material (Sec. 27-654). In industrial districts, wind and solar freestanding or pole or mounted solar power equipment requires minimum setback of 1 times the max equipment height except to Sunrise Blvd where it is 1.5 times (Sec. 27-535).
