The city's zoning code includes an article on solar access permits (Art. XII). It provides a number of solar access-related definitions, including a detailed one for "impermissible interference" (Sec. 52-889). The ordinance describes the solar collector permit application process and notes that approved applicants must deliver notice to any property owner subject to proposed restrictions (Sec. 52-891); a hearing may be conducted if requested (Sec. 52-892). The permit will be granted if it does not interfere with city plans, if benefits exceed burdens, and if no structures are already vested that would cause impermissible interference (Sec. 52-893). The permit protects the holder from impermissible interference, including from vegetation, and from the costs of enforcing the permit (Sec. 52-895). Permits terminate if the solar energy system is not used for 2 consecutive years or is not installed within 2 years of obtaining the permit (Sec. 52-897).
