solar energy

The county's Land Use and Development Code includes a section on solar energy systems (§35.30.160). In the coastal zone, roof-mounted systems are exempt from design review and planning permit approval, while freestanding systems require a coastal development permit or land use permit. In inland areas, roof-mounted systems are exempt from design review and planning permit approval, but do require building, electrical, plumbing, and solar use permits as applicable. Solar use permits are required if a system could have a specific adverse impact on public health and safety; systems will only be approved if they meet findings, including no adverse effect on public health and safety (§35.30.160.B.1). The code also addresses appeals regarding denials of solar use permits (§35.102.040.A.2, D.1). The term "solar energy system" is defined, as are related terms of "specific, adverse impact" and "feasible method" to mitigate those impacts (§35.110.020).
