Solar Energy

The county's zoning code includes a section on Alternative Energy Facilities that addresses solar (§ZS 1-344). The code provides definitions for both solar energy heating and power systems, as well as large (greater than 200 kW for grid sale), medium (5-200 kW or on-site use roof-mounted systems of greater than 5 kW), and small (less than 5 kW for on-site use) systems (§ZS 1-344.b).

Small and medium solar energy systems are permitted in any zoning district subject to standards (§ZS 1-105.c.6): they are considered accessory uses subject to setback and height limitations and standards addressing location, screening, glare prevention, and signage (§ZS 1-344.d.1).

Large systems are allowed in ag and industrial districts with a minimum parcel size of 25 acres, and in commercial, estate, and village districts with a minimum parcel size of 50 acres. A two-step approval process is required with concept plan approval preceding master plan approval; concept plan must include a sketch plan, designation of sensitive areas, drainage/stormwater management plan, decommissioning plan, and operations and maintenance plan (§ZS 1-344.d.2).
