Congress enacted the Religious Land Use & Institutionalized Persons Act (RLUIPA) in 2000, providing protections and relief related to religious freedom of persons, places of worship, religious schools, other religious assemblies, and institutions. The law was not intended to expand existing constitutional protections, but the practical effect has been to alter the balance of interests between those seeking approval of religious land use, local governments, and citizens.
This course explores RLUIPA basics and conflicts that have developed. RLUIPA provides for the recovery of attorney fees by a religious organization if it gets relief in the courts. The looming threat of these fees being assessed against municipalities has sometimes deterred effective planning.
This course brings together leaders from all quarters to state their positions and offer solutions to the dysfunctional process that has evolved in the decision making driven by RLUIPA.
